I. MANDATORY NOTICE — ACCEPTANCE OF TERMS

By purchasing, opening, handling, or using any product sold on this website (“Product(s)”), the purchaser and/or user (“User”) unconditionally agrees to all terms, warnings, and disclaimers listed below.
If the User does not agree, the Product must not be used under any circumstance.

Use of the Product constitutes a binding agreement to these terms.

II. HIGH-RISK MATERIAL WARNING

All Products are made of glass, a material that is inherently fragile and subject to breakage at any time, including during normal use.
The User acknowledges that glass can crack, chip, or shatter without warning and accepts full responsibility for all associated risks.

Products are NOT:

  • Dishwasher safe

  • Microwave safe

  • Heat safe

  • Oven safe

  • Freezer safe

  • Safe for hot, warm, or heated liquids

  • Impact resistant

  • Break-resistant

Any use outside the posted instructions constitutes misuse and immediately voids any potential claim against the seller.

III. ASSUMPTION OF ALL RISKS

To the maximum extent permitted by law, the User expressly and voluntarily assumes all risks associated with:

  • Handling, using, washing, storing, or transporting the Products

  • Breakage, cracking, shattering, or thermal shock

  • Cuts, lacerations, punctures, or injuries

  • Choking hazards from charms or detachable components

  • Property damage from breakage or spills

  • Injuries resulting from misuse or failure to follow instructions

  • Supervising children or minors who use or access the Products

The User acknowledges that these risks exist even when the Product is used properly.

IV. ABSOLUTE RELEASE OF LIABILITY

To the fullest extent allowed by law, the User hereby waives, releases, and forever discharges the seller, its owners, employees, agents, affiliates, manufacturers, distributors, and partners from any and all claims, demands, causes of action, damages, losses, liabilities, injuries, or expenses of any kind—whether known or unknown—arising from or connected to the Product, including:

  • Misuse or improper handling

  • Use with hot liquids or dishwasher exposure

  • Thermal shock or temperature misuse

  • Dropping or impact

  • Use by unsupervised individuals

  • Changes, modifications, or attempts to repair the Product

  • Ignoring posted safety warnings

  • Use of damaged, defective, or compromised glass

This release applies regardless of fault, including but not limited to seller negligence to the maximum extent allowed by law.

V. NO WARRANTIES — COMPLETE DISCLAIMER OF RESPONSIBILITY

All Products are sold strictly “AS IS”, WITH ALL FAULTS, and WITHOUT ANY WARRANTY WHATSOEVER.
To the fullest extent permitted by law, the seller disclaims all warranties, express or implied, including but not limited to:

  • Merchantability

  • Fitness for a particular purpose

  • Durability

  • Breakage resistance

  • Safety guarantees

  • Lifespan expectations

  • Non-defectiveness

The User assumes 100% responsibility for determining the Product’s suitability.

VI. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • The seller’s total cumulative liability for any claim related to the Product shall not exceed the original purchase price of the Product.

  • The seller shall NOT be liable for any indirect, incidental, consequential, punitive, special, or exemplary damages, including but not limited to:

    • Bodily injury

    • Property damage

    • Lost income or profits

    • Medical or legal costs

    • Emotional distress

    • Replacement of damaged items

These limitations apply regardless of legal theory, including breach of contract, tort, negligence, strict liability, or any other theory of recovery.

VII. CHOKING HAZARD & SMALL PART WARNING

Products that include charms or decorative accessories may contain small parts that can detach.
These components pose a choking hazard and must be kept away from children and pets.
User assumes full responsibility for ensuring safe storage and supervision.

VIII. USER RESPONSIBILITY FOR SUPERVISION

The Products are NOT intended for children under 12 years old.
Supervision is required for minors and for individuals with limited motor control.
The User accepts all responsibility for ensuring safe use by anyone under their care.

IX. USER RESPONSIBILITY FOR COMPLIANCE WITH LAW

The User is solely responsible for compliance with all local, state, national, and international regulations related to the use, handling, and disposal of glass materials.

X. CONDITION OF USE REQUIREMENT

The User agrees that:

  1. They have read and understood all warnings and instructions.

  2. They will inspect the Product before each use.

  3. They will discontinue use if any damage or defect is present.

  4. They accept all risks associated with the Product.

  5. They waive all rights to pursue claims against the seller, to the fullest extent permitted by law.

XI. AGREEMENT TO TERMS

By purchasing, opening, or using any Product, the User confirms and agrees that:

  • These terms constitute a legally binding agreement.

  • The User releases the seller from all liability to the fullest extent permitted by law.

  • Any dispute shall be resolved under the governing law chosen by the seller.

  • Continued use of the Product signifies ongoing acceptance of all terms.
